The petitioners apprehend their arrest in Rajoun P.S. Case No. 401/2018, registered for the offences punishable under Section(s) 379/411of the Indian Penal Code.

Informant got secret information that one tractor trailer loaded with illegal sand going from Punsia towards Bhagalpur. During patrolling, the informant along with other police officials saw a tractor trailer coming from Punsia side. Having seen the police party, the driver stopped the vehicle and fled away. The police seized the vehicle loaded with illegal sand.

No.27217 of 2019(3) dt.17-07-2019 2/2 It is submitted on behalf of the petitioners that petitioners have been falsely implicated in this case simply because they are owner and driver of the said tractor. The informant lodged this case against them as they refused to fulfill demand of illegal gratification. Petitioners have got no criminal antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 401/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) vinita/- U T
