JUSTICE MADHURESH PRASAD ORAL ORDER 12-04-2018 Heard counsel for the petitioner and APP for the State. Petitioner is an accused in a case registered for offence under sections 304B, 201 and 34 IPC.

Learned counsel for the petitioner submits that the petitioner is the father-in-law. He is a man of clean antecedent and has falsely been implicated in the instant case on the basis of general and omnibus allegation. Petitioner is in custody in connection with this case since 21.12.2017. Similarly situated coaccused, mother-in-law of the deceased, has already been granted bail by the court of Additional Sessions Judge vide order dated 20.11.2017 which has been detailed in paragraph 10 of the bail petition.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees

No.12978 of 2018 (3) dt.12-04-2018 2/2 Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 11, Gaya in Belaganj Police Station Case No. 363 of 2016 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
