JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 14-05-2025 After arguing at length, learned counsel for the petitioners seeks permission of the Court to withdraw the application as against petitioner nos. 1, 2, 3 and 7.

3. Accordingly, the present application is dismissed as withdrawn as against petitioner nos. 1, 2, 3 and 7. The present
Patna High Court CR. MISC. No.13818 of 2025(3) dt.14-05-2025 2/3 application survives only against petitioner nos. 4, 5 and 6.
4. The petitioner nos. 4, 5 and 6 apprehended their arrest in connection with Jandaha P.S. Case No. 155 of 2024 instituted for the offences under Sections 341, 323, 448, 302, 504/34 of the Indian Penal Code.
5. Prosecution story, in short, is that the accused persons including the petitioners have assaulted the son of the informant by means of sticks and rods, due to which he died.
6. Learned counsel for the petitioner nos. 4, 5 and 6 submitted that petitioner nos. 4, 5 and 6 are innocent ladies and have falsely been implicated in the present case. Learned counsel further submitted that general and omnibus allegation has been made against these petitioner nos. 4, 5 and 6. No specific overt act is alleged against these petitioner nos. 4, 5 and
6. Learned counsel further submitted that, as a matter of fact, the deceased was mentally challenged and he fell down, during altercation, bursting his head on the ground which caused his death. It has been submitted on behalf of the petitioner nos. 4, 5 and 6 that the petitioner nos. 4, 5 and 6 have no criminal antecedent. The co-accused person has already been granted regular bail by this Court vide order dated 17.12.2024 passed in Cr. Misc. No. 73592 of 2024.

7. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
8. Considering the aforesaid facts and circumstances of the case as also petitioner nos. 4, 5 and 6 being ladies having no specific allegation against them, let the petitioner nos. 4, 5 and 6, above named, in the event of arrest/surrender before the Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Jandaha P.S. Case No. 155 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
