JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Parsa P.S. Case No.82 of 2019 for the offence under Section 30(a)/36 of the Bihar Prohibition & Excise Act, 2016. In the instant case total 57 litres of foreign liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the liquor was seized from the Diyara (Chaur) and not from the house or conscious possession of the petitioner. Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand)

Patna High Court CR. MISC. No.10727 of 2020(2) dt.03-03-2020 2/2 with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Saran at Chapra in connection with Parsa P.S. Case No.82 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
