JUSTICE RAJESH KUMAR VERMA ORAL ORDER 16-07-2025 Heard Mr. Dr. Pranav Kumar, learned counsel for the petitioners, Ms. Renu Kumari, learned Additional Public Prosecutor for the State and Mr. Madhukar Mohan, learned counsel for the Complainant.
2. The petitioners are apprehending their arrest in connection with Complaint Case No. 5930 (c) of 2024 for the offences punishable under Sections 498A, 323, 379 & 504 of
2/4 the Indian Penal Code.
3. As per the Complaint Petition, the Complainant was married to one Sunny Saurav Singh on 21.11.2021. Prior to marriage, the petitioner side said that their son is Pilot in international Airlines and he gets Rs. 2,00,000/- as monthly salary. It is further alleged that the petitioner no.1 told that their son has secured job in Singapore airlines and to join, he needs to pay Rs.55,00,000/- which was paid by father of the complainant by selling land and then the marriage was performed. After marriage, the complainant discovered that the petitioner was neither Pilot nor he gets salary of Rs. 2,00,000/-. It is further alleged that the petitioners along with other co-accused person assaulted and abused the Complainant and also took ornaments and other articles from her almirah.
4. Learned counsel for the petitioners submits that petitioners have clean antecedent and they have falsely been implicated in the present case.

Pursuant to the direction of this Court, learned counsel for the petitioners has filed a supplementary affidavit stating therein that petitioners are ready to give Rs.10,00,000 (Rupees Ten Lakh) as one time settlement and they are also ready to return one diamond ring to the Complainant. He further
3/4 submits that as far as ornaments are concerned the Complainant has already taken away all her ornaments except one Diamond Ring and some other Silver items which petitioners are ready to return to the Complainant.
6. The learned Additional Public Prosecutor and learned counsel for the Complainant have vehemently opposed the prayer for bail of the petitioners.
7. Learned counsel for the Complainant on instructions submits that the Complainant is not ready to receive Rs. 10,00,000/- (Rupees Ten Lakh) as well as other articles from the petitioners.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Complaint Case No. 5930 (c) of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita and with other following conditions:-

Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below. ii. If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
