JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being brother of the informant is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/448/427 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the petitioner along with 4-5 others made indiscriminate firing on the informant while he was cultivating his land through his tractor causing injury to none but indiscriminate firing damaged tyre of the tractor causing loss of Rs.36,000/-.
It is submitted by learned counsel for the petitioner that in the background of land dispute the petitioner has lodged the present case against the informant being his own brother. A
Patna High Court Cr.Misc. No.11107 of 2015 (2) dt.28-04-2015 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Maheshi P.S. Case No.189 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
