NILU AGRAWAL ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 12.03.2017 in a case registered for offences punishable under Sections 272/273 of the Indian Penal Code and 30 (a) of the Bihar Excise Amendment Act, 2016.

The prosecution case is that on patrolling duty the informant along with the police party found a Maruti Suzuki Car DL-9CD-1055 carrying 38.625 liters of foreign liquor but any how, the accused managed to flee away but the name and mobile number of the petitioner was found on the back glass of the car. It is submitted by the learned counsel for the

It is submitted that the car does not belong to the petitioner and he has no criminal antecedent. Learned A.P.P. for the State, however, opposes the prayer for bail.

Considering the facts and circumstance of the case and that nothing has been recovered from the possession of the petitioner, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia (Banjaria) P. S. Case No. 132/2017. (Nilu Agrawal, J) Sudha/- U T
