====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 08-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Bhagwanpur Hat P.S. Case No. 265 of 2021 lodged under Sections 307, 504, 506/34 of Indian Penal Code read with Section 27 of Arms Act.
As per the allegation made in the F.I.R., on the date of election the son of the informant was alleged to be injured by gun shot made by the present petitioner, the injuries is at thigh whereas he actually fired on the informant's head. Learned counsel for the petitioner submits that petitioner is in custody since 30.11.2021, charge sheet has already been filed in this case, he has no criminal antecedent and present dispute is due to the result of political revolutionary
Patna High Court CR. MISC. No.13115 of 2022(2) dt.08-07-2022 2/3 on the date of election. Learned counsel for the petitioner further submits that petitioner is a student and his life shall be spoiled, if he shall continue in jail.
Learned counsel for the State opposes the prayer for bail and submits that due to fire made by the present petitioner, the son of the informant became injured in his thigh, injury report is at Annexure -4.
In the present facts and circumstances of this case that petitioner is a student and he is in jail since 30.11.2021, having no criminal antecedent and also considering the injuries upon the son of the informant which are due to lacerated wound and one shot is at right thigh, it is not vital portion of the body, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Shri A.K. Tripathi, Judicial Magistrate, First - Class, Siwan in connection with Bhagwanpur Hat P.S. Case No. 265 of 2021, subject to the following conditions as laid down under Section 437(3) of C.r.P.C.
The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail
Patna High Court CR. MISC. No.13115 of 2022(2) dt.08-07-2022 3/3 bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
