JUSTICE MADHURESH PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 18-04-2023 The petitioner, in the above public interest litigation, seeks an enquiry into the financial irregularities alleged to be prevailing in 'Bihar Rural Livelihoods Promotion Society, State Rural Livelihoods Mission, Bihar, called the 'JEEVIKA', by the Vigilance/Independent Agency or by constituting a Special Investigating Team. The petitioner also seeks monitoring of the enquiry by this Court. The petitioner in the writ petition has provided a number of show cause notices issued to the employees by the

Patna High Court CWJC No.3838 of 2022 dt.18-04-2023 2/2 Director, all dated 02.11.2015 as Annexure-1 series. Annexure-2 is a direction from the Government of India, Ministry of Rural Development regarding the very same show cause notices, which communication is dated 17.03.2016. Annexure-3 and 4 are also complaints on which show cause notices were issued, which were dated 25.09.2018. Annexure-5A is the order dated 10.03.2021 of the Lokayukta which recommended an enquiry by the Vigilance Department.

It is pertinent to mention that the Society itself had initiated action against the defaulting employees, as is evident from the show cause notices. The Lokayukta is also seized of the matter.

We are of the opinion that there is no reason, why an enquiry is to be directed by us or the same monitored. Since already such an enquiry has been recommended by the Lokayukta, we find no reason to entertain the writ petition and dismiss the same.
