Having regard to the fact that on account of order of dismissal passed by the disciplinary authority of the Bank this writ application, which was only filed against the memo of charge, has become infructuous, especially when the said order of dismissal in the departmental proceeding is appealable before the Board of Director of the Bank.

That being so, this application is dismissed as having become infructuous but nothing said in this order, however, shall come in the way of the petitioner in approaching the appellate

Patna High Court CWJC No.6351 of 2014 (2) dt.05-02-2015 authority against the order of punishment passed in the departmental proceeding during the pendency of this writ application.
