Petitioner apprehends arrest in Aurai (Muzaffarpur) Police Station Case No.253/2019 registered for the offences punishable under Section 7 of the EC Act.

On the secret information, authorities raided the village house of the petitioner and recovered 87 bags of wheat and 101 bags of rice kept for the purpose of black marketing. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to political rivalry and being a PDS dealer, she had kept food grains in the aforesaid godown for its convenient distribution amongst the beneficiaries. None of the beneficiaries has made any complaint against the petitioner. It is also submitted that no incriminating

Learned counsel for the State opposes the prayer for bail submitting that the food grains had been kept by the petitioner in an unauthorized godown at her village for black marketing.

Considering the gravity of the allegation against the petitioner, her prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) Shashi U T
