2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Salimpur P.S.Case No. 159 of 2024.
3. The informant is the brother of the deceased. He states that when he was taking tea at a tea stall, 11 named accused persons, including the petitioner, surrounded his brother and the petitioner and co-accused Bidyanand Kumar fired with a pistol which hit the head of the deceased and he died at the spot.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.12838 of 2025(3) dt.15-05-2025 2/2 that only one injury of fire-arms is present on the head of the deceased, according to the post mortem report, whereas there is allegation that the petitioner and co-accused Bidyanand Kumar fired at him.
5. On the other hand, the learned APP for the State and the learned counsel for the informant have submitted that there is specific allegation on the petitioner that he fired in the head of the deceased and also against co-accused Bidyanand Kumar.
6. The petitioner appears to be the assailant of the deceased. He does not deserve the privilege of bail which is hereby rejected.
