JUSTICE SANJAY PRIYA ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Rafiganj P.S. Case No. 76 of 2013 instituted for the offence under Sections 467, 468, 471 and 420 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that she was appointed as A.N.M. ® in Aurangabad in the year 2013, but she did not join that post because she belongs to Munger. Later on, she had applied for the post of A.N.M. and was selected for that. She has joined in the year 2016 as A.N.M and at present she is posted in Shahkund PHC, Bhagalpur, where she joined on 22.4.2016 after verification of all documents.

The counsel for the petitioner has submitted that merely on suspicion, since she did not join after being selected, the instant case has been filed. She has filed the same documents before the Civil

Patna High Court Cr.Misc. No.23002 of 2017 (2) dt.22-05-2017 2/2 Surgeon, Bhagalpur, which were found to be correct and, thereafter, she was selected for the job of A.N.M. and at present she is working in PHC Shahkund, Bhagalpur.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Rafiganj P.S. Case No. 76 of 2013, she shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.

with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
