JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 01-04-2019 The petitioner prays for a direction to the respondent authorities to pay him the ACP and MACP which had been recommended to be paid to him. The difficulty which was shown by the respondent authorities in not paying the same viz. non-availability of the attested service book also has been removed, but still no payment is being made to the petitioner.

2. It appears rather surprising that despite the petitioner having served the department for such a long time

Patna High Court CWJC No.5020 of 2019 dt.01-04-2019 2/2 and being entitled for the financial progression, the same is being denied without any reason. The only difficulty, as was communicated to the petitioner in the payment of the aforesaid financial progression after his retirement was nonavailability of the attested service book. It appears that now the service book has been sent to the District Welfare Officer, Bhagalpur (respondent No. 5).

3. Under the aforesaid circumstances, the petitioner is directed to make a fresh representation along with a copy of this order before the District Welfare Officer, Bhagalpur (respondent No. 5) within a period of four weeks from today, who, on receipt of such application, will be under obligation to dispose it off and pass a sequel order in accordance with law within a period of four weeks thereafter.

4. With the aforesaid observation/direction, the writ petition stands disposed off.
