JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and the learned A. P.P. for the State.

The petitioner seeks bail in connection with Bishanpur P.S. Case No. 113 of 2016, dated 04.12.2016, registered under Sections 341, 307 / 34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 03.12.2016 at about 10.15 night one Naushad Ali Khan, brother of the informant, along with his friend were coming to his house after closing the shop, then three persons riding on a motorcycle reached near the brother of the informant and out of three miscreants, one Tara shot fire through pistol causing injury to Naushad Ali Kha, brother of the informant. Thereafter, brother of the informant was rushed to Darbhanga Medical College and Hospital.

No.23375 of 2017 (2) dt.22-05-2017 2/2 The learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and similarly situated accused person, who has also not been named as accused in the same case, has been granted bail by this Court vide order dated 19.04.2017 in Cr. Misc. No. 11840 of 2017. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 20.12.2016.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM VII, Darbhanga in connection with Bishanpur P.S. Case No. 113 of 2016.
