The petitioners seek bail in Nokha P.S. Case No.353 of 2017 registered under Section 30 (a) & 37 (g) of the Bihar Prohibition and Excise Act, 2016.
86.6 liters of country made liquor is said to have been recovered from the field of Umesh Chaudhary, who disclosed the names of the petitioners as owners of the said liquor. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the conscious physical possession of the petitioners. They have no concern either with the place of occurrence or with the seized liquor and have no concern with the said Umesh Chaudhary.
Patna High Court Cr.Misc. No.8333 of 2018 (02) dt.16-02-2018 2/ 2 They have been falsely implicated in this case due to dirty village politics. They have no criminal antecedent. Petitioner no.1 has been languishing in custody since 06.12.2017 while petitioner no.2 since 29.11.2017.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-cum-Special Judge Excise, Rohtas at Sasaram in connection with Nokha P.S.
