JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 392, 395, 412 and 120B of the Indian Penal Code.
It is alleged that the accused persons stolen the idols of Ram-Janki & Laxman after breaking open the door of temple. Subsequently, the father of the petitioner informed the police about the incident.
It is submitted by learned counsel for the petitioner that when the petitioner has any role in the commission of the theft or keeping the stolen article then there was no occasion to father to inform the police. Petitioner is the government servant and a statement has been made in para 3 of the petition that the petitioner have no criminal antecedent.
Patna High Court Cr.Misc. No.12819 of 2015 (2) dt.27-03-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Itarhi P.S. Case No.137 of 2013, pending before the Chief Judicial Magistrate, Buxar. With the above observation, this application is, accordingly, disposed off.
