This is an application for bail in connection with Mansi P.S.Case No. 174 of 2016, corresponding to Sessions Trial No. 395 of 2016, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25( 1 b) a, 26 & 35 of the Arms Act.
Allegation as per FIR is that police on secret information raided the house of the petitioner and it was found that the petitioner and other co-accused persons were planning for committing dacoity and petitioner was arrested and one country made pistol and cartridges were recovered.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he is in
Patna High Court Cr.Misc. No.23019 of 2017 (2) dt.15-05-2017 2/2 custody for seven months. It has further been submitted that petitioner has been made accused in one more case but he is on bail in that case.
Heard learned APP also, who has opposed the prayer for bail stating that now Sessions Trial has commenced. Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.
However, learned trial court is directed to expedite the trial and try to conclude the same within a period of six months and at the same time the Superintendent of Police, Khagaria is directed to ensure the attendance of the witnesses in court on the date fixed so that the trial is concluded within the said period. With the above observations and directions, this application is dismissed.
