Petitioner seeks bail in a case registered for the offences punishable under Sections 302/201 of the Indian Penal Code.

Dead body of the daughter of the petitioner was noticed in an Aluminum container box by the local chowkidar and FIR was lodged against unknown. During investigation, it was suspected that the matter is of honour killing.

Submission is that the petitioner is in custody since 11.10.2017. Except suspicion, noting is there against the petitioner. Investigation of the case is already complete and the petitioner is ready to cooperate with the

Patna High Court Cr.Misc. No.10459 of 2018 (3) dt.09-04-2018 trial. The impugned order reveals that the petitioner had confessed before the police that he had committed the murder, as the victim was in love affairs with a relative Sarvesh Upadhyay.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Majhaulia Police Station Case No.298 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
