The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 107.640 litres of liquor is stated to have been recovered from the land of the sugar mill and on secret information it transpired that the same belongs to this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from his possession. He has no concern either with the seized liquor or with the place of recovery. He is in custody

Patna High Court CR. MISC. No.25017 of 2021(3) dt.21-12-2021 2/2 since 17.12.2020 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Baruraj P.S. Case no. 25 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
