The petitioner seeks bail in Simri P.S. case No.117 of 2017 case registered under Sections 341, 323, 326, 307, 498A/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act, but later on Section 304B of the I.P.C. has been added, pending in the court of A.C.J.M. IVth, Buxar.

Allegation against the accused persons including the petitioner is that they poured kerosene oil on the body of the deceased and set her on fire, due to which she sustained burnt injuries and during treatment she succumbed to death. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.10.2017. Charge sheet has been submitted in this case. There is no allegation of tampering of

Patna High Court Cr.Misc. No.6785 of 2018(2) dt.06-02-2018 2/2 witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He is the husband of the deceased. The onus is on the petitioner to explain the cause of death of the deceased. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The prayer for bail is rejected. The court below is directed to take all necessary steps to expedite the trial.
