Petitioner seeks pre arrest bail in a case registered for the offences punishable under Section 379 and other allied sections of the Indian Penal Code.

Prosecution's case, in brief, is that the petitioner in the night entered into the house of the informant, tossed her in the bed and caught her. He snatched her golden chain, ear ring and fled away.

Learned counsel appearing for the petitioner, denying the allegations, submits that the petitioner has falsely been implicated in this case due to quarrel between the children. Petitioner has got no criminal antecedent. Case has been lodged after delay of three days without explanation. State counsel points out that as per the allegation in

Patna High Court CR. MISC. No.15823 of 2020(2) dt.10-07-2020 2/2 the FIR, the petitioner entered into the informant's house in night and tried to outrage her modesty and on being unsuccessful he took away her golden ornaments. In view of the nature of allegation, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered on its own merit without prejudice.
