Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Kahalgaon P.S. Case No.43 of 2022 registered for offences under Sections 30(a) of the Bihar Prohibition and Excise Act 2016 and Amended Act, 2018.

Petitioner has clean antecedent and there is no recovery from the house of the petitioner but from a hut, the ownership of which it is denied by the petitioner. It is also submitted that the petitioner works in NTPC as temporary labourer.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Exclusive, Excise Court No.02, Bhagalpur in connection with Kahalgaon P.S. Case No.43 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
