The petitioner is apprehending his arrest in connection with Ara Town P.S.Case No.482 of 2017 dated 19.9.2017 registered for offences punishable under Sections 401 and 414 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is that while checking, the police intercepted a motorcycle and three persons were riding on that, two persons were arrested and one accused succeeded in fleeing away and it was disclosed that the motorcycle was of the stolen motorcycle.

Submission of the learned counsel for the petitioner is that he has been named by the co-accused Vikas Kumar and except that there is nothing against him and with Vikas Kumar he has enmity.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day..

With the aforesaid observation, this application is disposed of.
