JUSTICE PARTHA SARTHY ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B, 201, 363, 365 and 34 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that her husband who had gone to attend the marriage did not return. As such the FIR was registered. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. Subsequently in course of investigation, on the statement of one Deepak Kumar and Raunak Kumar the petitioner was interrogated by the police

Patna High Court CR. MISC. No.12324 of 2022(3) dt.22-12-2022 2/2 and it is alleged that he confessed to having committed the crime. It is submitted that the alleged confession has no value. No such confession was made nor does he have any concern with the alleged occurrence. The petitioner is in custody since 4.10.2021 and charge sheet has been submitted against him. The application for bail is opposed by learned APP for the State and learned counsel for the informant. It is submitted by learned counsel for the informant that not only the petitioner confessed to having committed the crime but also has criminal antecedents which he suppressed in his application filed in the learned trial Court.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation against this petitioner together with the petitioner having remained in custody since 4.10.2021, the Court directs the petitioner to be enlarged on bail in connection with Bibhutipur P.S. Case no. 169 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-II, Rosera, Samastipur.
