JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420/471/349 and other allied sections of the Indian Penal Code.

Petitioner is alleged to have cheated public by making advertisement to give them costly vehicle, cash etc. as prize and on showing them lucky winner, accused persons charged them sales tax, registration tax, GST etc. and thus collected huge amount.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. He has been named in the FIR on the confessional statement of co-accused. No witness has supported the allegation made against the

Patna High Court CR. MISC. No.12494 of 2022(2) dt.16-08-2022 2/2 petitioner. His name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent. Several similarly situated co-accused have already been allowed bail by co-ordinate benches of this Court vide paragraph 9 of the petition.

Considering the nature of allegation against the petitioner, in the event of arrest/surrender within six weeks from today, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Warisaliganj Police Station Case No. 360 of 2018, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
