JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Raxaul P.S.Case No. 47 of 2017 registered under Sections 20, 22, 23 and 24 of Narcotic Drugs and Psychotropic Substance Act.

Allegation in brief is that 1Kg 800g Charas was recovered from the apple box being transported by a truck and the apple was booked by the petitioner and he was also traveling in the same truck.

Learned counsel for the petitioner submits that charas was not recovered from personal possession of the petitioner but it was from an apple box.

Leaned counsel for the State submits that apple was being transported by the petitioner who was present in the Truck and in

Patna High Court Cr.Misc. No.7975 of 2018 (2) dt.12-02-2018 2/2 the said case trial is proceeding.

Having considered the aforesaid facts and circumstances of the case, the prayer for bail of the petitioner is rejected with a direction to the trial court to expedite the trial and conclude the same preferably within a year.
