This application for regular bail arises out of Saraiya P.S. Case No. 96 of 2020, disclosing offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Considering the submission that in similar circumstance co-accused Ravi Kumar has been granted bail by this Court by an order dated 30.01.2021, passed in Cr. Misc. No. 28324 of 2020, in my opinion, a case for grant of regular bail is made out. The petitioner is in custody since 09.12.2020. Learned Additional Public Prosecutor has not been above to distinguish the petitioner's case with that of said Ravi

Considering the above, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in Saraiya P.S. Case No. 96 of 2020.
