Petitioner seeks bail in a case registered for the offences punishable under Sections 394 and 328 of the Indian Penal Code.

The FIR is against unknown. The petitioner is in custody since 04.12.2017 after remand from some other case. Submission is that nothing has been recovered from possession of the petitioner nor the petitioner was ever put on TI Parade. Investigation of the case is already complete. Only material against the petitioner is confession before the police and criminal antecedent.

Considering the fact of this case that there is no substantial material against the petitioner, let the petitioner, above

Patna High Court Cr.Misc. No.20168 of 2018 (2) dt.13-04-2018 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Muffasil Police Station Case No. 125 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the court below.
