Petitioners apprehend their arrest in a case registered for the offences punishable under Section 323 and other allied sections of the Indian Penal Code.
Prosecution's case in short is that the petitioners surrounded the informant and on the order of Mahhamd Hussain, Mohhamad Shahil (petitioner no.3) gave Daab blow on his head as a result of which he sustained injury, Sonu gave Tangi blow on is head and Md Hussain assaulted him by Lathi. Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. Petitioners have got no criminal antecedent. Parties are agnate
Patna High Court CR. MISC. No.11184 of 2020(3) dt.26-08-2020 2/2 and have pending land dispute. FIR has been lodged after two days of occurrence without explanation.
Considering the facts of the case, let the petitioners named above, in the event of surrender before the Court below within six weeks from the date of receipt of this order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Hussainganj Police Station Case No. 290 of 2019, subject to the conditions laid down under sections 438 of the Code of Criminal Procedure.
