Heard Mr. Deepak Kumar, learned Advocate for the petitioners and Mr. Md. Aslam Ansari learned APP. The petitioners seek bail in anticipation of their arrest in connection with Kawakole P.S. Case No. 240 of 2020 dated 30.07.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 354(B), 379 and 448 of the Indian Penal Code.

Though both the petitioners are said to have taken part in the assault but the accusation is absolutely general and omnibus. Several persons have been made accused in this case and some of them have been attributed with specific overt act.

No.22604 of 2021(2) dt.10-05-2022 2/2 The learned counsel for the petitioners has submitted that there is counter version of the occurrence also and there are injuries from both sides. Though from the side of the prosecution, seven persons have been injured, out of whom one has received grievous injuries, but such injuries are not specifically attributable to the petitioners.

Apart from this, it has been submitted that all the accused persons of this case as well as of the counter case have been released on bail.

Considering the afore-noted circumstances and taking into account the fact that the petitioners do not have criminal antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nawada in connection with Kawakole P.S. Case No. 240 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
