JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Heard learned counsels for the petitioner, informant and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

It is alleged that the petitioner entered into an agreement with the informant to transfer 7 katha 3 dhoor land for consideration of Rs.3,91,000/-. Initially, after taking consideration amount of Rs.80,000/- 1 katha 2 dhoor land was transferred by the petitioner but after taking rest of the consideration amount i.e. Rs.2,31,000/- rest land was not transferred in favour of the informant.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.11062 of 2015 (2) dt.28-04-2015 2/2 neither any specific date of payment has been given nor there is any proof with regard to payment.

It is submitted by learned counsel for the informant that petitioner had also filed a writ application with regard to the dispute between the parties and proceeding under section 144 was also initiated between the parties.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Saran in connection with Sonepur P.S. Case No.347 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
