The petitioner seeks regular bail in connection with Atri PS case no. 75 of 2015 registered for the offences punishable under Sections 307, 353 and other sections of Indian Penal Code and 27 of Arms Act.
It has been alleged that a mob of 100-115 unknown persons armed variously had engaged in altercation with the informant side and when the police party arrived there, the police party was also attacked causing injury to the police personnel. Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner, petitioner has clean antecedent and is languishing in judicial custody since 04.07.2016. Patna High Court Cr.Misc. No.30379 of 2017 (2) dt.06-07-2017 2/2 situated co-accused has already been granted bail vide order dated 28.04.2016 passed in Cr.Misc. no. 17241 of 2016. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial MagistrateII, Gaya in connection with Atri PS case no. 75 of 2015.
