This petition is a Public Interest

Patna High Court CWJC No.4835 of 2025(5) dt.01-12-2025 2/3 Litigation, seeking directions from this Hon'ble Court to the respondent authorities to construct the building of the Additional Primary Health Centre on the land, measuring an area of 1 Acre 5 Decimal situated in Mauza- Dewra, PS- Kutumba (now Amba) District- Aurangabad, donated by the Dewara Tole villagers, with a registered gift deed No.- 6381 dated 19/05/1988, for that purpose, on the request of the then Hon'ble Health Minister, Bihar, for the construction of a 6-bed hospital in Dewra Tola, village Badkagaon, PS-Kutumba (now Amba), District Aurangabad. However, the Circle Officer of Kutumba, without verifying this fact, recommended the other plot bearing Plot No.- 928 of the same Mauza for the construction of the building of the Additional Primary Health Centre.

Further prayer is sought for direction upon the Circle Officer, Kutumba, to reconsider and make a fresh recommendation for construction of building of the Additional Primary Health Centre over the land donated by the villagers for that purpose in 1988, at the request of the then Health Minister."

Upon perusal of the records and considering the nature of grievance raised, petitioner is directed to make a fresh representation before the District Magistrate, Aurangabad (Respondent No. 3), who shall consider the petitioner's grievance and pass an appropriate order in accordance with law, preferably within a period of four weeks' from the date of receipt/production of this order.

3. With the aforesaid observations, the writ petition stands disposed of.
