2. The petitioner seeks bail in a case registered for the offence punishable under Sections 364, 365 and 34 of the B.N.S..
3. As per prosecution case, informant, namely Sikandar Yadav, alleged that on 14.06.2022 at around 11 PM while his son was on his way to Ghailadh for taking medicines, in the meantime, he was ambushed near Mahavir Temple by the accused persons who abducted him.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case due to village politics. As a matter of fact, son of informant was never

During course of investigation, the victim was recovered by the police from the house of brother-in-law (Sarhu) of informant. Similarly situated co-accused, namely Arvind Yadav, who was also named by the victim in his statement recorded under Section 164 of the Cr.P.C., has already been granted bail by the learned trial court. Petitioner claims clean antecedents and he is in custody since 30.08.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation, clean antecedents and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Madhepura P.S. Case No. 564 of 2022.
