2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Punpun P.S. Case No.389 of 2024, registered for the offence under Sections 103(1), 61(2) and 238 of BNS.
3. According to the case of prosecution, in this case, the name of the deceased is Santu Kumar. According to the information given by his father Navdeep Prasad Singh, on 23.11.2024, the deceased left his house along with accused Nawal Yadav but he did not return. His dead body was lying found near the railway track. On the basis of information given by Navdeep Prasad Singh, offence has been registered against named accused persons and some 4-5 unknown accused persons
Patna High Court CR. MISC. No.14476 of 2025(3) dt.12-05-2025 2/3 and during course of investigation on the basis of mobile tower of the petitioner, he has been arrested.
4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in the present case. The mobile phone, which is allegedly used by the present applicant, is belonged to his wife. The statement of his wife is not recorded by the prosecution, therefore on the basis of the mobile tower location of mobile phone of the wife of the petitioner, it cannot be said that he has any connection with the alleged crime. The petitioner is in custody since 11.12.2024 and in this case, charge sheet is not filed and the trial will take more time, therefore, on these grounds, it is prayed that the petitioner may be granted benefit of bail.

8. Considering the submissions made by the counsel for the petitioner and particularly considering the evidence collected by the prosecution against the present
Patna High Court CR. MISC. No.14476 of 2025(3) dt.12-05-2025 3/3 applicant without further commenting on other merits of the case, I am of the view that it is a case where the petitioner should be granted benefit of bail.
9. Accordingly, the application is allowed.
10. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masaurhi, in connection with Punpun P.S. Case No.389 of 2024.
