JUSTICE SANJAY PRIYA ORAL ORDER 2/ 23-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Jehanabad Rail P.S. Case No.86 of 2016 instituted for the offence under Section(s) 457, 380/34 Indian Penal Code.

As per written report, theft has been committed in the house of the informant. Informant raised suspicion against this petitioner and two other accused persons.

It has been submitted that there is no recovery from the possession of the petitioner. No Test Identification Parade was held. Name of this petitioner has come in the confessional statement of the co-accused in para 15 of the case diary. It has further been submitted that one of the co-accused has already been granted bail by a co-ordinate Bench of this Court by order

Patna High Court Cr.Misc. No.23722 of 2017 (2) dt.23-05-2017 2/2 dated 06.04.2017 passed in Cr. Misc. No.15306 of 2017. It has been stated in para 3 of the petition that the petitioner has clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Railway Court, Gaya, in connection with Jehanabad Rail P.S. Case No.86 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
