1. Heard learned counsel for the petitioners, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Section 80 of the B.N.S.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant being sister in-law (Jethani) and brother in-law (Bhainsur) of the deceased. The learned counsel next submits that informant alleges that his daughter was married to Sanjeev Kumar on 09.12.2020 and after
Patna High Court CR. MISC. No.13988 of 2025(3) dt.13-05-2025 2/3 marriage, the accused persons including the petitioners were demanding a Swift Dzire Car, and on account of non-fulfilment of dowry demand, the victim was tortured. It is further alleged that on 26.07.2024, Sanjeev informed the informant about the death of the deceased, as such, the informant came to the place of occurrence and saw the dead body of his daughter lying and thus, alleges that she was killed by the accused persons by strangulating her.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that informant is not an eye witness to the occurrence. It is also submitted that had the petitioners been involved in the occurrence, then effort would have been made to dispose of the dead body with a view to conceal evidence, but then, the dead body was sent for post mortem and the doctor preserved the viscera for medical examination, which amply demonstrates that no sign of external or internal injury was found leading to death. It is further submitted that viscera report has come and no poisonous substance was found. It is also submitted that whenever any occurrence of the nature as alleged takes place, the entire family members are implicated in a mechanical manner with general and omnibus allegation.
5. Learned A.P.P. as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail

The learned counsel appearing on behalf of the informant submits that in the event, if privilege of anticipatory bail is granted to the petitioners, they may abscond, on which the learned counsel appearing on behalf of the petitioners submits that petitioners will not abscond rather will cooperate in the investigation to establish their innocence.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XVth, Muzaffarpur East in connection with Sakra P. S. Case No.390 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
