The petitioner is languishing in custody since 05.06.2018 in a case registered for the offences punishable under Sections 387 and 506/34 of the Indian Penal Code. The accusation against the petitioner is of demanding of extortion of Rs.5,00,000/- from the informant through his mobile phone.
It is submitted by learned counsel for the petitioner that even assuming the offence to be true, only accusation under Section 387 of the IPC is made out against the petitioner. It is further submitted that investigation has already been concluded. Learned APP for the State submits that the petitioner has demanded an extortion amount of Rs.5,00,000/- from the
Patna High Court CR. MISC. No.12313 of 2019(2) dt.28-02-2019 2/2 informant.
Considering the fact that only extortion money was demanded and no amount have been paid, coupled with the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM-Ist Class, Danapur, Patna in connection with Ranitalab P.S. Case No.37 of 2018. Since the petitioner is having serious criminal antecedent, learned Court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
