JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307,279,427 and 379 of the Indian Penal Code.

The prosecution case is that on 6.10.2015 at 1.30 P.M. the informant was carrying the children of A.B. Ascent Public School on his mini bus when one motorcyclist suddenly came from opposite direction and due to rash and negligent driving he collided with the bus as a result he received injury. Thereafter the accused persons including the petitioner assaulted the informant, damaged the vehicle and presuming him to be dead, threw the informant in a drain. The accused persons snatched the

It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general and there is counter version of the occurrence. The nephew of the petitioner was dashed by rash and negligent driving by the informant resulting into lodging of Amarpur P.S. Case No. 303 of 2015 by the father of the petitioner which is at earlier in point of time. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Amarpur P.S. Case No.304 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
