The petitioner seeks bail in a case instituted under Sections 10(a) 10(b)/11/12 of U.A.P. Act, Sections 13/20/17 of C.L. Act and Sections 25(1-B)a/26/35 of the Arms Act. The prosecution story, in brief, is that one pistol along with 9 live cartridges is said to have been recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.06.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. One pistol along with 9 live cartridges are said to have been recovered from

Patna High Court Cr.Misc. No.23224 of 2017 (2) dt.22-05-2017 2/2 the possession of the petitioner. There is no compliance of Section 100 of the Cr. P.C. The other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge, Patna City, in connection with S. T. No. 835 of 2016, arising out of Malsalami P.S. Case No. 160 of 2016. (Sudhir Singh, J) Amit/- U T
