This is an application for regular bail in connection with Town P. S. Case No. 761 of 2017 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

Informant, who is father of the victim girl, has stated that his daughter Ruksar was studying in Class-IX and on 14.10.2017 she had gone to appear in examination and thereafter did not return. He made search for her but she could not be traced out. The victim girl was recovered and in her statement recorded before the Magistrate on 19.10.2017 she had not named this petitioner but named one Akash as the main

Patna High Court Cr.Misc. No.14454 of 2018(3) dt.06-04-2018 2/2 accused. However, subsequently in her statement recorded on 24.10.2017 under Section 164 Cr. P.C., she has named petitioner for the first time as accused. She has also stated that she did not know petitioner from before. The Medical Board found her age to be 17 to 18 years. Petitioner has no criminal antecedent and he is in custody since 25.10.2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur, in connection with Town P. S. Case No. 761 of 2017.
