The petitioner apprehends his arrest in Ghosi P.S. case No. 325 of 2018 registered under Section 341, 504, 354, 354(B), 506 of the Indian Penal Code.

The victim alleged that on 23.08.2018 at about 4.20 PM while she was returning from school, the petitioner intercepted her cycle and abused her. The petitioner torn her clothes and also snapped her photographs.

The learned counsel for the petitioner submits that the occurrence is improbable and the same cannot happen on such busy road in the view of many persons but nobody raised objection. It is further submitted that son of petitioner provided job to the father of informant and when father of informant was removed from service the informant lodged this false case but it

Patna High Court CR. MISC. No.12363 of 2019(2) dt.05-03-2019 2/2 appears from perusal of the FIR that the victim made specific allegation that petitioner intercepted her while she was returning from school by cycle, abused her, torn her clothes and also snapped her photographs.

Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below, the learned court below shall consider the prayer for bail of petitioner on its own merit without being prejudiced from the order of this court.
