The present application, under Section 439(2) of the Code of Criminal Procedure, has been filed seeking cancellation of anticipatory bail granted to opposite party No. 2, who is on bail in connection with Barh P.S. Case No. 54 of 2015, registered for the offences punishable under Sections 467, 468, 471, 420 and 120B of the Indian Penal Code, from the Court of learned Sessions Judge, Patna by

Patna High Court Cr.Misc. No.24448 of 2016 (3) dt.09-01-2017 2/2 furnishing incorrect facts.

On perusal of the First Information Report and materials available on the record, without commenting upon the merits of the case, as it may prejudice the case of either of the parties, I am of the view that no case for cancellation of bail is made out.

This application has no merit and is, accordingly, dismissed.
