The petitioner seeks regular bail in connection with Kadamkuan PS case no. 656 of 2018 registered for the offence punishable under Section 307 and other sections of Indian Penal Code, 27 of Arms Act and 3/4 of Explosive Substances Act.

The allegation is regarding 30-40 persons, armed with lathi, danda, iron rod etc., having damaged the vehicle and shops and further, had also assaulted several persons after an incident of accident had taken place. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is an accused in

Patna High Court CR. MISC. No.12226 of 2019(2) dt.27-02-2019 2/2 one other case but he is on bail in the said case. The petitioner is said to be languishing in custody since 06.12.2018. Lastly, it is submitted that similarly situated co-accused person has already been granted bail by a co-ordinate Bench of this Court vide order dated 04.02.2019 passed in Cr.Misc. no. 5992 of 2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Patna in connection with Kadamkuan PS case no. 656 of 2018.
