JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-01-2017 In view of the averments made in the counteraffidavit, learned counsel for the petitioner would submit that the grievances of the petitioner in respect of payment of difference of salary, GPF and gratuity have already been redressed.
In that view of the matter, he would seek leave to withdraw the present writ petition with liberty to represent before the authority concerned in respect of her claim for grant of family pension.
Patna High Court CWJC No.5477 of 2015 (5) dt.13-01-2017 2/2 Leave is granted.
The application is disposed of.
In case the petitioner files a representation before the authority concerned in respect of her claim for family pension, the same shall be examined and disposed of by a reasoned and speaking order within two months from the date of filing of the representation and if it is found that the petitioner is entitled to receive family pension, admitted amount should be paid to her within a period of three months from the date of final decision.
