JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kako P.S. Case No. 170 of 2018, G.R. No. 1594 of 2018 for the offenses under Sections 306 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 08.01.2019. Referring to the prosecution case he submits that the FIR, which is said to be registered at the instance of the deceased, does not indicate that the petitioner was instrumental in committing suicide by the deceased. He further submits that the death of the deceased is in a suspicious circumstance as it appears from the Doctor's notes that after the informant was taken to the hospital, the informant left the

Considering the fact that the petitioner has no criminal antecedent, he is in custody since 8.1.2019 and there is no material to suggest that the petitioner was instrumental in committing suicide by the deceased, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jehanabad in connection with Kako P.S. Case No. 170 of 2018, G.R. No. 1594 of 2018.
