JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 307, 435, 504 and 506 of the Indian Penal Code. It is alleged that the informant was assaulted by coaccused Vishwanath Yadav and Manoj Yadav (non-petitioners) and when Ratilal Yadav, Kishun Devi and Lila Devi came to rescue the informant, then they were assaulted by co-accused Vishwanath Yadav, Jang Bahadue Yadav, petitioner Deo Narayan Yadav and Raj Kumar Yadav when Raj Kumar Yadav snatched silver ornament from the neck of the wife of the informant. It is submitted by learned counsel for the petitioners that no accusation of assault is alleged against Lal Babu Yadav when

No.8472 of 2015 (2) dt.27-02-2015 2/2 accusation of assault against Raj Kumar Yadav and Deo Narayan Yadav is omnibus and general and there is counter version of the occurrence also. Moreover, co-accused Jang Bahadur Yadav has been granted anticipatory bail by this Court vide Cr. Misc. No. 7023 of 2015. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Keoti P.S. Case No. 135 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
