The petitioner seeks bail in connection with Konch P.S. Case No.137 of 2020, registered for the offence punishable under Sections 147, 148, 149, 341, 307, 326, 302, 504 of the IPC and section 27/35 of the Arms Act.
Earlier the prayer for bail of the petitioner was rejected vide order dated 12.04.2021 passed in Cr. Misc. No.2421 of 2021. Thereafter, the petitioner has filed this application. Vide order dated 30.03.2022, a report was called for, regarding the stage of trial. In compliance thereof, a report sent by learned Additional District and Sessions Judge-Ist, Gaya, dated 06.04.2022, is kept at flag 'P', whereby it is submitted that out of fourteen charge sheet witnesses, seven witnesses
Patna High Court CR. MISC. No.13052 of 2022(3) dt.11-05-2022 2/2 have been examined as yet and the time likely to be taken in conclusion of the trial is about six months.
Considering the submissions made in the report, I am not inclined to grant bail to the petitioner named above. The prayer for bail is hereby rejected.
Accordingly, the bail application is dismissed. However, the trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of six months from today.
If the trial is not concluded within the stipulated period, the petitioner is at liberty to renew his prayer for bail. (Anjani Kumar Sharan, J) pallavi/- U T
