This is a case registered under Section 392 of the Indian Penal Code.
It is submitted by the counsel for the petitioner that the allegation of loot is against unknown persons. Name of the petitioner has come during course of investigation. Though it is alleged that one SIM bearing no. 8651042928 was being used in the stolen cell phone by the petitioner but neither the cell phone nor the SIM has been recovered from the petitioner's possession. Identity proof submitted in respect of the said SIM does not contain the petitioner's photograph. He submits that he has been arrested merely on the basis of suspicion and there is nothing to incriminate him in the instant case. He is in custody since

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Patna in Didarganj P.S. Case No. 231 of 2016 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
